Appeal of Judgment Approving the Class Action Heads to Court of Appeal

The judgment of Paulsen on 14 December 2023 certified the Land Class Action against EQC (now renamed NHC), however it was not on the terms sought.

The judgement did not allow those with Increased Flooding Claims (IFV), or those with assigned claims to be part of the class. The plaintiffs appealed these parts of the decision, as well as a previous decision on indemnity value.

EQC appealed the judgment of 14 December 2024 as well, claiming that the common issues will not advance individual claims, that the plaintiffs claim is meritless and that certain arguments are time-barred.
